TERMS OF SERVICE
Effective Date: May 13, 2026
Last Updated: May 13, 2026
PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING ANY PRODUCT. BY ACCESSING OR USING THIS WEBSITE, PLACING AN ORDER, OR ENROLLING IN A SUBSCRIPTION, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS WEBSITE OR PURCHASE ANY PRODUCTS.
- Acceptance of Terms These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Bongo Commerce LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of the State of Delaware, operating the Yunae Hair brand at www.yunaehair.com. These Terms govern your access to and use of the website located at www.yunaehair.com (the "Website") and all products, subscriptions, and services offered through the Website (collectively, the "Services").
By (i) accessing or browsing the Website, (ii) creating an account, (iii) placing an order, or (iv) enrolling in a subscription, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. Your continued use of the Website after any modification to these Terms constitutes acceptance of the revised Terms.
- Eligibility and Age Requirements The Website and Services are intended solely for individuals who are eighteen (18) years of age or older. By using the Website, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding contract. If you are under eighteen (18) years of age, you are not permitted to access the Website, create an account, or purchase any products.
If the Company becomes aware that a person under the age of eighteen (18) has provided personal information or placed an order, we will take steps to remove such information and cancel any associated orders. The Company reserves the right to verify the age of any user at any time.
- Definitions For purposes of these Terms, the following definitions shall apply:
• "Subscription" means a recurring purchase arrangement under which the Customer authorizes the Company to charge the Customer's payment method on a recurring basis at a selected interval in exchange for periodic shipment of Products.
• "Products" means all dietary supplements, wellness products, and related items offered for sale through the Website.
• "Billing Date" means the date on which a recurring subscription charge is processed against the Customer's payment method.
• "Subscription Portal" means the self-service account management interface accessible through the Website footer, through which Customers may manage their Subscription.
• "Chargeback" means a reversal of a payment initiated by the Customer's payment card issuer or bank.
• "Intellectual Property" means all trademarks, service marks, trade names, logos, domain names, patents, copyrights, trade secrets, and other proprietary rights owned or licensed by the Company.
- Subscriptions, Automatic Renewal, and Cancellation 4.1 Automatic Renewal Authorization By purchasing a Subscription Product, you agree that your Subscription will automatically renew at the selected delivery interval (e.g., monthly, every two months, every three months) unless you cancel prior to your next Billing Date. You expressly authorize the Company to charge your selected payment method on a recurring basis for each Subscription order at the then-current Subscription price without requiring additional authorization for each individual recurring charge.
Your Subscription will continue indefinitely until canceled by you or terminated by the Company in accordance with these Terms. The frequency and amount of recurring charges will correspond to the Subscription plan selected at checkout.
4.2 Pre-Checkout Disclosure By completing your purchase, you acknowledge and confirm that prior to finalizing checkout you were clearly presented with: (i) the recurring nature of the Subscription; (ii) the billing frequency; (iii) the recurring charge amount; (iv) the next Billing Date; and (v) instructions for how to cancel. This disclosure satisfies the requirements of Section 4 of the FTC's Negative Option Rule, 16 C.F.R. Part 425, as amended.
4.3 Subscription Management Customers may manage their Subscription at any time through the Subscription Portal accessible through the footer of the Website. Through the Subscription Portal, Customers may:
• cancel their Subscription;
• pause their Subscription;
• skip an upcoming shipment;
• delay upcoming shipment dates; or
• update payment method or shipping address.
Any changes to your Subscription must be completed before your next Billing Date in order to take effect for the upcoming shipment. Changes made after a renewal charge has been processed may apply to the following Subscription cycle.
4.4 Cancellation Confirmation Upon cancellation, you will receive an email confirmation at the address on file confirming that your Subscription has been successfully canceled and that no further recurring charges will be processed unless you subsequently reactivate the Subscription.
4.5 Price Changes The Company reserves the right to change Subscription pricing at any time. If the price of your Subscription changes, the Company will provide you with advance notice of the new price before it takes effect, using the email address on file with your account. Such notice will be provided no fewer than thirty (30) days before the price change takes effect. By continuing your Subscription after the price change takes effect, you accept the new price. If you do not accept the new price, you may cancel your Subscription before the change takes effect.
4.6 Company's Right to Cancel The Company reserves the right to cancel any Subscription at its sole discretion at any time, including in cases of suspected fraud, abuse, or violations of these Terms. In such event, you will receive a prorated refund for any unused portion of your current Subscription period.
- Pricing, Taxes, and Payment All prices displayed on the Website are in U.S. dollars. The Company reserves the right to modify prices for Products at any time. Price changes will not affect Subscription orders that have already been processed; however, future recurring charges will reflect any applicable price adjustments as described in Section 4.5.
You are responsible for all applicable sales taxes, use taxes, or similar charges imposed by any governmental authority in connection with your purchase. The Company will collect and remit sales tax in jurisdictions where required by law.
By placing an order, you represent and warrant that: (i) any payment information you supply is true and complete; (ii) you are authorized to use the payment method; and (iii) charges incurred by you will be honored by your financial institution. The Company reserves the right to cancel or hold orders where fraud or unauthorized use of a payment method is suspected.
- Shipping, Delivery, and Risk of Loss The Company ships Products to addresses within the United States. Shipping times are estimates only and are not guaranteed. The Company is not responsible for delays caused by shipping carriers, weather events, customs processing, or other circumstances outside the Company's control.
Risk of loss and title for Products pass to you upon delivery to the carrier. If a shipment is lost or damaged in transit, you should contact the shipping carrier directly to file a claim. The Company will cooperate in good faith to help resolve shipping issues but does not guarantee replacement of lost or damaged shipments beyond what is required by applicable law.
Shipping fees are non-refundable except where required by applicable law or as expressly stated in the Company's refund policy.
- Refund Policy and Money-Back Guarantee 7.1 Ninety-Day Money-Back Guarantee Bongo Commerce LLC (operating as Yunae Hair) offers a ninety (90) day Money-Back Guarantee on eligible first-time Subscription purchases made directly through the Website. To qualify, any unopened bottles must be returned within ninety (90) days from the date the order was delivered. This guarantee is limited to first-time Subscription purchases only and applies exclusively to Products purchased directly from www.yunaehair.com.
Limit: one (1) Money-Back Guarantee claim per household. Shipping fees are non-refundable. The Company reserves the right to deny refund requests in cases of suspected abuse, fraud, excessive refund requests, or violations of these Terms.
7.2 How to Initiate a Return To initiate a return, email info@yunaehair.com with your order number and reason for return. The Company will provide a Return Merchandise Authorization ("RMA") number and return shipping instructions. Products returned without a valid RMA number may not be accepted. Return shipping costs are the responsibility of the Customer unless the return is due to a Company error or a defective product.
7.3 Refund Processing Approved refunds will be issued to the original payment method used at purchase. Please allow five (5) to ten (10) business days for the refund to appear in your account following the Company's receipt and inspection of returned Products. Refunds may take additional time to process depending on your financial institution.
7.4 Non-Eligible Orders The Money-Back Guarantee does not apply to: (i) orders placed through third-party retailers or marketplaces; (ii) Subscription renewal orders after the initial purchase; (iii) promotional or heavily discounted orders; or (iv) Products that have been opened, used, or damaged.
- Chargebacks and Payment Disputes Before initiating a chargeback or payment dispute with your bank or credit card issuer, you agree to first contact the Company at info@yunaehair.com to attempt to resolve the issue. The Company typically responds to customer inquiries within two (2) business days and in most cases can resolve disputes more quickly than the chargeback process.
Customers who file fraudulent, false, or unjustified chargebacks — including chargebacks filed after receiving a product, after a valid refund was issued, or for Subscription charges that were properly authorized — may be: (i) permanently denied future purchases at the Company's sole discretion; (ii) referred to appropriate law enforcement or collection agencies; and (iii) pursued for monetary damages, including chargeback fees and legal costs incurred by the Company.
In response to any chargeback or payment dispute, the Company reserves the right to submit relevant evidence to payment processors, banks, and financial institutions, including but not limited to: delivery confirmation records; tracking information; order history; Subscription enrollment consent; recurring billing authorization; customer communications; and cancellation or Subscription management history. By placing an order through the Website, you consent to the use of these records to resolve payment disputes.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such jurisdictions, the Company's liability is limited to the maximum extent permitted by law.
- Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BONGO COMMERCE LLC (YUNAE HAIR), ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, PRODUCTS, OR SERVICES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall the Company's total aggregate liability to you for all claims arising out of or relating to these Terms, the Website, or any Products or Services exceed the greater of: (i) the total amount you paid to the Company in the twelve (12) months preceding the claim; or (ii) one hundred U.S. dollars ($100.00).

Indemnification You agree to defend, indemnify, and hold harmless Bongo Commerce LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (i) your violation of these Terms; (ii) your use of the Website or Services; (iii) your violation of any third party's rights; or (iv) any claim that your use of the Website or Services caused damage to a third party.
-
Binding Arbitration and Class Action Waiver 17.1 Agreement to Arbitrate PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Services or Products (collectively, "Disputes") will be resolved solely by binding, individual arbitration, and not in a class, representative, or consolidated action or proceeding. You and the Company agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement, and that you and the Company are each waiving the right to a trial by jury or to participate in a class action.
17.2 Exceptions Notwithstanding Section 17.1, you and the Company each retain the right to: (i) bring an individual action in small claims court for disputes within the applicable monetary limit; and (ii) seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
17.3 Arbitration Rules and Procedures Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. The arbitration will be conducted in English. Unless you and the Company agree otherwise, the arbitration will be conducted in the county where you reside or, at your election, telephonically. The arbitrator will have the power to award any remedy available under applicable law.
For Disputes involving amounts less than ten thousand dollars ($10,000), you may choose whether to submit written materials only or proceed by telephone hearing. For Disputes involving amounts of ten thousand dollars ($10,000) or more, the right to a hearing will be determined by the AAA rules. Filing fees, arbitrator fees, and administrative fees will be governed by the AAA Consumer Arbitration Rules.
17.4 Class Action Waiver YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. UNLESS BOTH YOU AND THE COMPANY AGREE, NO ARBITRATOR MAY CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.
17.5 Informal Dispute Resolution Before initiating arbitration, you agree to first contact the Company at info@yunaehair.com and attempt to resolve the Dispute informally for a period of sixty (60) days. If the Dispute is not resolved within sixty (60) days, either party may initiate arbitration.
- Governing Law and Jurisdiction These Terms and any Dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provision or rule. For any matter not subject to arbitration under Section 17, you and the Company consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
If you are a resident of a jurisdiction that requires disputes to be resolved in local courts or under local law, the foregoing choice of law and forum may not apply to you to the extent prohibited by applicable law.
- California Auto-Renewal Disclosures If you are a California resident, the following additional disclosures apply pursuant to California Business and Professions Code Section 17600 et seq.:
• Subscription plans automatically renew unless canceled before the renewal date.
• The Company will charge the credit card or other payment method on file at the frequency selected during checkout (e.g., monthly, every two months, or every three months).

• To cancel, log in to your account and use the Subscription Portal, or contact customer support at info@yunaehair.com.
• You will receive an acknowledgment of cancellation by email upon successful cancellation.

- Modifications to These Terms The Company reserves the right to modify these Terms at any time at its sole discretion. When we make material changes, we will update the "Last Updated" date at the top of these Terms and, where practicable, notify you by email at the address on file. Your continued use of the Website or Services after the effective date of any revised Terms constitutes your acceptance of the revised Terms.
It is your responsibility to review these Terms periodically. If you do not agree to any revised Terms, you must discontinue using the Website and Services and cancel any active Subscriptions before the effective date of the revised Terms.
-
Force Majeure The Company shall not be liable for any delay or failure to perform any obligation under these Terms where such delay or failure results from any cause beyond the Company's reasonable control, including without limitation: acts of God; natural disasters; pandemic or epidemic; war; terrorism; civil unrest; actions of governmental authorities; strikes or labor disputes; Internet outages; supply chain disruptions; or any other event of force majeure.
-
Third-Party Links and Services The Website may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms and privacy policies of any third-party websites or services that you visit.
-
Severability If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable or, if modification is not possible, shall be severed from these Terms, and the remaining provisions of these Terms shall continue in full force and effect.
-
Waiver No failure or delay by the Company in exercising any right or remedy provided under these Terms or by law shall constitute a waiver of that right or remedy. No waiver by the Company of any breach of these Terms shall be effective unless it is in writing and signed by an authorized representative of the Company.
-
Entire Agreement These Terms, together with our Privacy Policy and any other legal notices published by the Company on the Website, constitute the entire agreement between you and Bongo Commerce LLC with respect to your use of the Website and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.
- By opting in you agree to receive recurring automated promotional and personalized marketing text messages from Yunae Hair at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Consent is not a condition of purchase.
